Med Spa Rules in Delaware

What Delaware law and its licensing boards say about who may do med spa treatments, each with its source. This is a plain-English summary, not legal advice.

  1. In Delaware, physicians who delegate tasks to non-physicians follow the Board of Medical Licensure's general delegation rule, found in 24 DE Admin Code 1700, section 11.0. [1]
  2. The Board of Medical Licensure requires direct supervision, meaning the delegating physician is on the premises and performs an evaluation or consultation, when a diagnosis is made or a treatment plan with prescription medications is started. [1]
  3. Under the Board's rules, indirect supervision means the physician is on the premises or reachable electronically and able to be there in person within 30 minutes. [1]
  4. The Board of Medical Licensure says standing orders may not be used to make a diagnosis or prescribe medication. [1]
  5. The Board of Medical Licensure says a delegating physician cannot be involved in patient care in name only. [1]
  6. Delaware's esthetics apprenticeship rules list approved peels for training as acids at pH 3.5 or above, such as glycolic, salicylic, mandelic and citric acid. [2]
  7. The Delaware Board of Nursing requires IV therapy given by licensed nurses to be authorized by a written order from a state-licensed prescriber. [3]
  8. The Board of Nursing says IV procedures done by a licensed practical nurse must be supervised by a registered nurse, an advanced practice registered nurse or a physician. [3]
  9. Delaware law gives advanced practice registered nurses full practice and prescribing authority once their license is issued, and the old collaborative agreement requirement was repealed effective August 4, 2021. [4]
  10. You can check a Delaware physician, nurse or esthetics license on the Division of Professional Regulation's DELPROS License Look-Up. [5]
  11. You can also check a Delaware nurse or advanced practice nurse license through Nursys QuickConfirm. [6]
