Med Spa Rules in Tennessee

What Tennessee law and its licensing boards say about who may do med spa treatments, each with its source. This is a plain-English summary, not legal advice.

  1. Tennessee defines a medical spa as any business, however named or organized, that offers or performs cosmetic medical services, but an individual physician's office counts only if it advertises as a medical spa or more than half of its patients in the past 12 months received elective cosmetic services. [1]
  2. Under that law, a cosmetic medical service is any service using a biologic or synthetic material, a chemical application, a mechanical device or an energy form of any kind that alters or damages, or can alter or damage, living tissue to improve appearance. [1]
  3. Tennessee Board of Medical Examiners rules say any procedure within the practice of medicine that is performed with a laser is the practice of medicine. [2]
  4. Every medical spa offering cosmetic medical services must register with the Tennessee Board of Medical Examiners before operating and name a medical director or supervising physician who accepts responsibility for those services. [3]
  5. The medical director or supervising physician must be an MD or DO with an active Tennessee license and an active medical practice in Tennessee. [3]
  6. A medical spa registration lasts 12 months and must be renewed, and operating without registration is unprofessional conduct for the supervising physician. [3]
  7. A medical spa must display its medical director's or supervising physician's name, and whether that physician is board certified, at the practice site and in its advertising. [4]
  8. Board of Medical Examiners rules say that, apart from limited exceptions such as some established patients, a physician may not prescribe or dispense any drug, in person, electronically or online, unless the physician or a licensed supervisee under protocols has first done and documented an appropriate history and physical exam. [2]
  9. The same rule also requires a documented diagnosis, a treatment plan discussed with the patient, and availability for follow-up before any drug is prescribed or dispensed. [2]
  10. Board of Medical Examiners rules say anyone performing a laser procedure within the practice of medicine must be supervised by a licensed physician, apart from limited exceptions set by state statute. [2]
  11. Tennessee limits licensed aestheticians to removing only the non-living epidermal layers of facial skin for beautification and bars techniques that affect the living dermis. [5]
  12. Tennessee aestheticians may use alpha-hydroxy acid salon exfoliants of up to 30% concentration, and the rule says such products should have a pH of 3.0 or above. [5]
  13. Tennessee cosmetology board rules bar invasive procedures, including electricity that contracts the muscle and abrasion of skin below the non-living epidermal layers. [5]
  14. Tennessee nurse practitioners who prescribe work under a supervising physician, following written protocols they develop together. [6]
  15. That physician need not be on site at all times but must be available for consultation, review at least 20% of the nurse practitioner's charts every 30 days, and visit any remote site every 30 days. [6]
